    Smoothgraph Connect Co., Ltd. (referred to as “Smoothgraph Connect”) respects your privacy and personal data rights, whether you are a registered member or a user accessing our services through the SEP Platform (referred to as the “Platform”). To give you confidence that your personal data is fully protected under personal data protection laws, Smoothgraph Connect has created this Privacy Notice to inform you of the details and purposes regarding the collection, use, or disclosure of your personal data, in accordance with Section 23 of the Personal Data Protection Act B.E. 2562 (PDPA).

    SEP Platform collects your personal data as follows:

    1. Personal Information, such as full name, occupation, job title, business type, and company name.
    2. Contact Information, such as email address and phone number.

    Purposes to collect, use or disclose, and Legal Bases

    SEP Platform hereby informs you of the purposes, details, and legal bases for collecting, using, or disclosing your personal data for the operation of SEP Platform as follow:

    To contact when you submit a request through the form.

    • Legal Bases: Legitimate Interests under Section 24(5)

    To offer and recommend services, such as Corporate Website development, Performance Marketing, and AI Search services.

    • Legal Bases: Legitimate Interests under Section 24(5)

    To activate the system and grant trial access to the platform by creating a Trial Account and allocating user permissions for SEP Platform based on your request

    • Legal Bases: Performance of a Contract under Section 24(3)

    Retention Period of Personal Data

    SEP Platform will retain your personal data for as long as reasonably necessary to fulfill the stated purposes. Once this period expires, we will delete, destroy, or anonymize your personal data so that it can no longer identify you.

    An exception applies where retention is necessary for the establishment of legal claims or during an ongoing legal dispute under judicial processes until the final enforcement period expires under applicable law.

    Persons or Entities to Whom Personal Data May Be Disclosed

    SEP Platform may disclose your personal data in accordance with the stated purposes or as prescribed by law to the following persons or entities:

    • Government agencies with statutory authority: Such as police officers, the Revenue Department, courts, or other competent authorities.
    • Other persons or entities: For which you have given explicit consent to disclose your personal data.

    In disclosing such personal data, SEP Platform will implement appropriate security measures to safeguard and prevent any unauthorized or unlawful use or disclosure of your personal data by such persons or entities.

    SEP Platform complies with the personal data security measures prescribed under Section 37(1) of the Personal Data Protection Act B.E. 2562 (2019) to prevent unauthorized or unlawful loss, access, use, alteration, modification, or disclosure of your personal data.

    You have the following rights regarding your personal data held or controlled by SEP Platform:

    1. Right to withdraw consent: You can withdraw your consent at any time for the specific purposes you previously agreed to.
    2. Right to access and obtain a copy: You can request access to, receive a copy of, or request disclosure of how your personal data was obtained, in case where you did not provide consent for such collection.
    3. Right to data portability: You can request your personal data formatted in an automated format, or ask us to transfer it directly to another data controller.
    4. Right to object: You can object to the collection, use, or disclosure of your personal data.
    5. Right to erasure: You can request to delete, destroy, or anonymize your personal data so that it can no longer identify you.
    6. Right to restriction of processing: You can request to restrict or suspend the use of your personal data.
    7. Right to rectification: You can request to update, complete, and correct your personal data so that it is accurate and not misleading.
    8. Right to lodge a complaint: You can submit a complaint to the expert committee under personal data protection laws.

    You may exercise rights 1–8 by submitting a written request through the channels provided by SEP Platform. Please note that SEP Platform may refuse your request where permitted by the Personal Data Protection Act or other applicable laws.
